Prosecution wrapped up the testimonies of their witnesses yesterday and today the defense had the opportunity to present their witnesses.
The defense first called Doctor Janice Ophoven who specializes in forensic pathology.
After tests and analysts she received and performed on little Damien, she concluded that there was no evidence of abuse of neglect, but he had an "Acute Life Threatening Event" that led to his death.
She says that the lack of oxygen to the brain which caused a fatal injury is the reason he died but the manner of death is undetermined.
Doctor Ophoven says that from choking on his on vomit, his severe anemia and complications from the newborn period could all have led up to the lack of oxygen to the brain and can't say that it was abuse that caused his death.
The defense then called pediatric physician Doctor John Galaznik who has a special interest in child abuse cases.
Doctor Galawznik says that there have been studies done to show that shaking may or may not cause trauma.
He says that the baby was in bad health from birth and when he was choking on his vomit, the lack of oxygen to the brain caused the trauma that killed him.
He says that choking and trauma can cause the brain swelling that Damien had.
The trial continues tomorrow and there is still no word yet if Sonny Alloway will testify.
