A man accused in connection with a Fairmont murder has his trial delayed.

23-year-old Donnell Lee was schedule to go to trial on July 16th for a first degree murder charge in connection with the shooting death of Derek Osborne in May of 2007.

Monday his lawyer asked for more discovery from the state and for the trial to be pushed back becaue of a scheduling conflict. The judge granted the motion and the trial is rescheduled for August.

Lee was also arraigned on a new conspiracy to commit murder charge and charges of breaking without entering, fraudulent use of an entry device, forgery and uttering. He plead not guilty to all those charges.

The conspiracy charge will be joined with the first degree murder charge and will be included in the August trial.
