Federal Regulators have told 5 News that the Occupational Safety and Health Administration has jurisdiction over the accident that killed a rig worker in Mrion County Monday night.

A rig over-turned and crushed the worker at CONSOL Energy's Loveridge Preparation Plant in Fairview. CONSOL Energy officials told 5 News that the company had granted Seitel, Inc. access to its property to conduct conduct geophysical seismic testing, for which it had obtained the necessary permits.
That testing was not associated with CONSOL's active coal mining or gas operations. State OSHA officials say the case was turned over to them because the accident didn't happen on bonded mine property.
