Former Jr. ROTC Teacher Sentenced for Sex Abuse

CHARLESTON, W.Va. (AP) - A former Kanawha County Junior ROTC instructor convicted of having a sexual relationship with a student will serve 52 weekends in jail.
Forty-four-year-old Martin Dale Kirby also will spend five years on supervised probation and must register as a sex offender.
Media outlets report that Kirby was sentenced Wednesday in Kanawha County Circuit Court. He had entered a Kennedy plea to sexual abuse by a person of trust in January. Under the Kennedy rule, a defendant doesn't admit guilt.
Kirby was hired as a Junior ROTC instructor at George Washington High School in 2010. Prosecutors say he had a sexual relationship with a 17-year-old female student in September 2010.

Someone's 'generalizations' apparently feels no matter the age, if a 10 year old 'consented' to sex that would make it okay? What a TWISTED, SICK mind! Seek HELP!

Some people obviously don't understand difference between a CHILD and an ADULT. Defending the sexual abuse of a CHILD repulses me! How sick! Disgusting! Perverted! Twisted!

A CHILD is anyone UNDER the age of 18! I guess if it was YOUR child you'd feel the same way? If so, I sure pity your children!

I am so sick of the generalizations and assumptions when it comes to these types of charges. Everyone assumes that she was victimized. She was 17 years old. Maybe she made a choice to pursue him. Maybe she wasn't victimized at all. Is she mentally disabled making her more vulnerable? Because she is 17, technically her parents get to decide how to handle this regardless of what the girl has to say. I know this may not be the "popular" opinion but when female teachers have relationships with young boys they get probation. This sends a clear message that male "victims" are less important than the female "victims". Maybe he opted for the Kennedy rule because there was a mutually consenting relationship. She is old enough to get a job, have a drivers license and probably even have an abortion if she chose but she is not old enough to give consent to have sex? This law is outdated and too black and white. To say that no one below the age of 18 can give consent is about as accurate as saying that everyone over the age of 18 is a mature adult. Do some research. When a teacher gets sentenced to 2 1/2 years in prison for having a relationship with a consenting student and within two months the same judge sentences a 54 old grandfather to 13 months for criminal sexual contact with his granddaughter who was only 7 there is a huge problem. What constitutes a victim? Here is another case-19ish yo male now has to register as a sex offender for having a consenting relationship with a 15 or 16 yo girl. The girls family moves to another state and guess what...now there is another boy there that has to register because it happened again! Where is the accountability for her? for her parents? Where are they in this mess? Anyway, I am all for punishing a true predator with a true victim. I also do not like the fact that teachers (or any adult) is having relationships with students. BUT, ruining a mans life because of a law that does not take into consideration her motivations and makes the age of the "victim" the only factor worth considering is unfair and ridiculous.

Under the Kennedy rule, a defendant doesn't admit guilt. Oh how 'quaint'; a Kennedy rule for perverts to plead to rather than Guilty or NOT guilty. How totally STUPID!

When does our legislators/Governor start looking into the increase of teachers abusing CHILDREN sexually??? How many more Governor??? How many more. Is he still teaching? I know teachers union always 'defends' these perverts.
