5 NEWS UPDATE: Rig Worker Dead After Accident Near Loveridge Plant in Fairview

UPDATE 1/15/2013:
Federal regulators said the Occupational Safety and Health Administration has jurisdiction over a fatal accident involving a gas-drilling rig at the Loveridge Preparation Plant.
UPDATE 1/15/13:
The following is an e-mail 5 News received from Consol Energy officials at 4:10 p.m.:

At 6:10 PM Monday evening, CONSOL Energy was notified by an independent surface drilling subcontractor that one of its employees who was performing work near the Loveridge Preparation Plant was fatally injured when a small core drilling rig he was operating rolled over.

CONSOL Energy granted Seitel, Inc. access to its property to conduct geophysical seismic testing, for which it had obtained the necessary permits. The independent testing was not associated with CONSOL Energy's active coal mining or gas operations.

State and federal agencies as well as OSHA were notified Monday evening and are on-site today to begin investigating the cause of the incident. CONSOL Energy will provide updated information related to the investigation as it becomes available.

FAIRVIEW, W.Va. (AP) - Federal regulators say they're working with the Occupational Safety and Health Administration to decide who has jurisdiction over a fatal accident involving a gas-drilling rig at a coal mine prep plant.
Mine Safety and Health Administration spokesman Jesse Lawder says an unidentified worker died Monday night when the rig overturned and crushed him at CONSOL Energy's Loveridge Mine preparation plant in Fairview.
Lawder says the rig was doing exploratory work on Marcellus shale gas deposits, drilling 30-foot holes and setting off explosives for seismic testing.
The state Office of Miners' Health Safety and Training says it's turned the case over to OSHA because the accident didn't occur on bonded mine property.
Pennsylvania-based CONSOL didn't immediately comment. The victim worked for one of its outside contractors. That company wasn't immediately identified.

CONSOL Energy officials confirm a fatality from the accident near the Loveridge Preparation Plant in Fairview. We're told the person was an independent drilling contractor. CONSOL said state and federal agencies have been notified. They're expected to be at the scene tomorrow.

At 6:10 PM Monday evening, CONSOL Energy was notified by a surface drilling contractor that one of its employees who was performing work independent of CONSOL Energy was fatally injured outside the vicinity of the Loveridge Preparation Plant.
State and federal agencies have been notified and are expected on-site at the location of the incident tomorrow.
The Marion County 911 Center is reporting a vehicle accident at the Loveridge Preparation in Fairview. We're told mine security called 911 saying some sort of a vehicle rolled over.
They couldn't release any more details. No word if a person is involved, but we do know the medical examiner is on the scene. We can't confirm any fatalities at this time.
