In July, a lawsuit was filed against the Barbour County Commission and sheriff.
The sheriff has denied the claims made against him, and the commission is now doing the same. They've filed a motion to dismiss the claims made against them in court.
They're asking the judge to remove them from the lawsuit filed by Brittany Keene.
In it, Keene alleges the commission should have known that Sheriff John Hawkins engaged in sexual acts with her in 2011.
The commission's attorneys said they can't be held responsible for the supervision or training of an elected official.
