It looks like city officials in Westover aren't going to give up in their attempt to claim the Morgantown Mall as their own.

On Monday Westover Mayor Dave Johnson told 5 News the city plans to file another petition with commissioners in Monongalia County to try and annex the mall.

Last year commissioners struck down the city's second try to annex the mall.

After commissioners denied their attempt, Westover city officials filed a writ of error citing they didn't like the way commissioners made their decision.

On Monday a judge approved the city's motion to dismiss the writ of error.

Johnson told 5 News he feels they have a better chance of annexing the Morgantown Mall by just submitting another petition.
