Circuit Court dismisses appeal by Consol to overturn lower court decision on retiree benefits

TRIANGLE, Va. (WDTV) -- The Fourth Circuit Court of Appeals dismissed an appeal by Consol Energy Tuesday to overturn the decision to continue paying for healthcare benefits to around 3,400 retired miners and their families.

In March, a decision was issued by the Federal Court for Southern West Virginia in Bluefield that Consol was attempting to stop paying contractually-obligated benefits, replacing it with a plan to fund health savings accounts for 5 years without the guarantee of lifetime coverage.

In a press release Thursday, the United Mine Workers of America International President Cecil E. Roberts called the appeal dismissal a “step forward” in the case.
