A judge with the Public Service Commission recommended Thursday that utilities for Timberline Four Seasons Resort be handed over to Canaan Valley Public Service District.
Parties involved can file exceptions to the recommendation for up to 15 days. If none are filed, the change will become officials in 20 days.
Timberline Four Seasons Utilities has been under investigation since December after concerns arose about the utility not having a licensed operator working for the utility; having inconsistent billing; the utility’s phone being disconnected; payroll checks to staff being declined for insufficient funds, and being under a constant boil water advisory.
CEO Frederick Herz was also arrested for the company's unpaid taxes.
TFSU services 743 sewer customers and 428 water customers in Tucker County.

An evidentiary hearing was held today to discuss the complaints filed against Timberline Four Seasons Utilities.
The Public Service Commission of West Virginia issued an official statement about the investigation, citing multiple complaints from customers.
Customers expressed concerns over not having a licensed operator working for the utility; inconsistent billing; the utility’s phone being disconnected; payroll checks to staff being declined for insufficient funds; and being under constant boil water advisory.
One formal complainant at the hearing said she's like to see Timberline no longer be able to service water.
"I would like to see the utility company have the water taken away from them by the PSC and never return again," said Janet Deal. "It has been too mismanaged and no upgrades to anything have been happening."
Timberline Four Seasons Utilities serves approximately 743 sewer customers and 428 water customers in Tucker County.
The PSC has had a General Investigation open into Timberline since August 2018.
The Chief Executive Officer of Timberline Four Seasons Resort is behind bars Thursday morning after the company did not pay taxes for a year.
According to the criminal complaint, an investigation began in October regarding unpaid taxes by the resort. The investigation revealed that the company did not pay taxes for 12 months.
As of October, the company owed $4,258.29.
Frederick Herz is charged with not paying the taxes.
